I have been having a problem with a certain person and i need a legal advice.

 

I was employed as a shop attendant by a person i thought was my friend. He used to take money from the till and after one month, he had spent a total of 56,000. Later after he discovered it, he changed the ownership and gave it to his father who, made me account for everything. I prepared the documents and showed him the cashflow of the business since i was employed. Later, after i convinced him, he changed the ownership to another one of his sons and they wanted to force me to pay the 56,000 shilling but i refused. Later, we hired an auditor and we found out that the business cant account for 10,000, and i was asked to pay. We entered into an agreement that i pay the amount in  instalment but later, the family became too harsh on me and i gave up paying after i had payed 3,000. The agreement consisted of the family as witnesses and one of the brothers was the owner. If this issue goes to court, what can be my defence?

By accepting to make the payments it could be said that you accepted responsibility for the money.  The best case would be to have the original person who took the money to accept the blame.  If that is not possible then you might try to make a payment schedule.  I would also be careful if I were you because they could accuse you of stealing and force you into a criminal proceeding.  What ever arrangement you make make sure it is in writing and signed and dated.
