Im so confused! I am co ex on my fathers will, my brother who had nothing to do with my father not even attending the funeral is now hired a lawyer and making all kinds of demands. He recieved over 100,00 from my father and i was to recieve the family home. Now my brother hired a lawyer wants me to secure estate which in the will it states i do not need to, demanding all records of when i was poa, wants his half of home, im so confused no family left to help me, IM BREAKING DOWN, HELP PLEASE,
if you are in possession of your father's house then don't leave possession and let him file asuit on the basis of will.it is tough to prove the willas per law.

I moved to texas to take care of my ailing grandmother and to keep her from having to go into a nursing home after 2 years she has passed. I am entitled 50% beneficiary along with my sister according to the will. my grandmothers sisters daughter was named the executor. She called me and informed me that I had to move before the 23rd of October or I would be evicted.. Can she do this? my grandmother died August 16, 2013. This has been my home and I was not paid to care for my grandmother and she needed 24 hour care so I was not able to get a job. I don't know what to do... I was at the least hoping to stay in my home until it was sold and I was to receive my monies.. please answer quickly I need help.. the constables were here and left a paper for me to call so it is happening I need knowledge ....I need recourse
Has the will been adjudicated? Have you paid the inheritence tax? Assuming that you have no money, maybe what you should do is sell the house or get a loan against it. Go to a loan broker or a real estate agent and find out if you can sell or borrow against the property. You can also sell all the property in the house for cash.
Once a the matter is in the court you can sell or encumber nothing.
